Calling all fitness junkies, sensation seekers, and the rest of the population who have yet to check their resolutions for 2017! 1 Mont Kiara will be hosting its first ever “Stairathon”, where we challenge everyone to take on a total of 1,370 steps all the way to the top of Wisma Mont Kiara, then down into 1 Mont Kiara mall.

The first of its kind for any Malaysian mall, 1 Mont Kiara’s Stairathon was organised to address an affliction that has smothered our urban community: lethargy. Long are the days spent in a windowless office, where many of us have been deprived of sunlight and physical activity, as we are bound to our seats, and the computer screens that we serve.

Well not anymore!

September 24th shall be the day when we step out, step up, and Rise To The Occasion at Wisma Mont Kiara! That will be the day when we strip ourselves of our own sluggishness, and rejuvenate our senses as we race to the 20th floor atop the office tower. The ascend will be difficult, but not impossible, and we will all become champions of our health! Of course, this Stairathon will not end at the top, as everyone will have to descend all twenty floors on foot to the finishing line at 1 Mont Kiara mall, where they will be properly awarded for conquering the tower.

There will be four categories, and four champions, but we will all arrive as winners at the end of the line, where a variety of performances, games, and even a lucky draw session await us.

STAIRATHON ROUTE AT WISMA MONT KIARA

  • 1st Staircase Route – “The Sunrise Climb” (From Ground Floor to Level 20)
    • Participants are to start the Race by ascending to the Rooftop on Level 20 from the
      Starting Point near H&M’s signage—1st Route Entrance.
    • Participants are to adhere strictly to the Rules and Regulations debriefed during the
      “Climb Safety Brief” before the start of the race.
  • At the Rooftop (Level 20)
    • Participants can catch a breath by taking a quick snapshot at the designated Photo Booth (optional; not compulsory).
    • Once their photos are taken, participants may proceed to the 2nd Route: “The Deal Breaker”.
  • 2nd Staircase Route – “The Deal Breaker” (From Level 20 to Ground Floor)
    • Participants are to complete the second leg of the race by descending through the 2nd Staircase Route, then to the Finishing Point (in front of Pierre Cardin Lingerie).
    • Kindly follow the directions displayed along the route to get to the Finishing Point.
  • TO OBTAIN YOUR FINISHER MEDAL ON THE GROUND FLOOR, 1 MONT KIARA
    • Participants must complete BOTH staircase routes (1st & 2nd) through the designated race areas to collect their Finisher Medals at the Finishing Point.
    • Finisher Medals must be collected on the spot upon finishing the race.

STAIRATHON TERMS & CONDITIONS

1MK Retail Sdn. Bhd. is the official organiser of this anticipated, first-ever fitness event known as Stairathon 2017 which will be held at 1 Mont Kiara Shopping Mall.

All Participants are bound by the following terms and conditions which are deemed effective throughout the duration of the Event.

1. DEFINITION

  • “Entry Fee” means the price of entry into the Event as set out in the Registration Form.
  • “Event” means Stairathon 2017 organised by the Organiser to be held at 1 Mont Kiara.
  • “Event Day” means the date of the Event which is on 24 September 2017.
  • “Organiser” means 1MK Retail Sdn. Bhd.
  • “Participant” means the person who will be participating in the Event.
  • “Parties” means the Organiser and the Participant.
  • “1 Mont Kiara” means 1 Mont Kiara shopping mall located at No. 1, Jalan Kiara, Mont’ Kiara, 50480 Kuala Lumpur.
  • “Race Pack” means the official pack issued by the Organiser to the Participant containing all relevant Event materials.
  • “Registration” means registration for the participation of the Event by way of online registration or on-site registration.
  • “Registration Form” means the such registration form prescribed by the Organiser to be completed by the Participant in order to apply, register and pay for participation in the Event.
  • “Terms and Conditions” means the terms and conditions relating to the Event as set out below.

2. REGISTRATION AND ELIGIBILITY

  • Registration can be made either by online registration portal or at our on-site registration counter located at 1 Mont Kiara which will be informed via our marketing materials and social media websites. The Participant shall complete the Registration Form and submit it together with payment of the Entry Fee in accordance with the prescribed manner.
  • Any individual irrespective of nationality whose age meet the minimum age of 18 on the Event Day is eligible to participate in the Event in accordance with the following categories :

(a) Category A – Female aged 18 to 40

(b) Category B – Male aged 18 to 40

(c) Category C – Female aged 40 and above

(d) Category D – Male aged 40 and above

  • The Participant will be placed under listed categories according to their age group upon the Registration. For avoidance of doubt, anyone who is below the age of 18 is not allowed to participate.
  • Each participant must sign the Release Of Claims, Waiver Of Liability And Assumption Of Risk in such form and upon such terms to be prescribed by the Organiser before participating in the Event.
  • The Organiser reserves the right to refuse participation of any entries without assigning any reasons thereof.
  • The Organiser also reserves the right to cancel, vary and/or add any Event category without giving any prior notice.
  • The Participant is strictly not allowed to transfer their entries to another party or change Event categories after their Registration are finalised.
  • The Participant who is prone to heart attacks, asthma, high/low blood pressure, respiratory and skin problems, other related health complications, acrophobia (“fear of heights”) is strongly advised NOT to participate.
  • The Participant is strongly advised to consult with their medical practitioner to ensure that their health (both mental and physical fitness) is permissible to enter into the Event. To ensure safety of the Participant, they are advised to follow the route designated and observe traffic regulations.
  • The Participant may collect their Race Pack at the place and date to be informed by the Organiser via its marketing materials or any of the Organiser’s existing social media website.
  • The Participant is solely responsible to ensure that they arrive and collect their Race Pack before the collection period closes.

3. ENTRY FEE

  • For online registration, Entry Fee can be paid by your country’s currency via your existing Paypal account or in Malaysian Ringgit (MYR). For on-site registration, Entry Fee must be made in Malaysian Ringgit (MYR). The Participant acknowledges that the Entry Fee is non-refundable.
  • Upon payment of Entry Fee being made, the Participant’s participation for this Event is confirmed and we will send them an email notification with the issuance of an Event identification number, which is non-exchangeable for any other items.
  • If the Participant does not receive any email notification within 24 hours after the payment has been made, the Participant has to report this issue to the Organiser within three (3) working days. Only full payment of the Entry Fee is deemed accepted as participation into the Event.
  • By submitting an application and paying the Entry Fee, the Participant agrees to enter the Event and also agrees to abide by all Terms and Conditions stipulated herein and any instructions given to them by the Organisers, officials and marshals before, during or after the Event.
  • The Participant shall not be entitled to a refund of the Entry Fee if he or she is disqualified from the Event as a result of a breach of any Terms and Conditions stipulated herein.

4. DISQUALIFICATION, CANCELLATION, WITHDRAWAL AND ALTERATIONS

  • Entries are non-transferable either to a different Participant or to another event in the current year or in future years.
  • The participant who fails to arrive at the start line on time will be assumed withdrawn from the Event and will not be eligible to a refund of any kind. No late starters will be permitted to cross the start line.
  • The Organiser reserves the right to alter the start time of the Event. In the event of a change of start time, the Participant will be notified of the revised start time. No refund shall be made for any change in start time for the Event.
  • If the Event is cancelled due to circumstance beyond the control of the Organiser including but not limited to, an act of God, explosion, acts of a public enemy, war, insurrection, terrorist act or threat of terrorist act, sabotage, epidemic, embargoes or strikes, the Participant shall not be entitled to a refund of the Entry Fee and compensation of any kind.
  • The Organiser reserves the right to alter the start time of the Event. In the event of a change of start time the Participant will be notified of the revised start time. No refund shall be made for any change in start time for the Event.
  • The Organiser reserves the right to change the date of the Event. In the event of such change of date of the Event, where the Participant is unable to attend on the revised date, he/she has fourteen (14) days to inform the Organiser in writing (or by email) from when the change in date is announced to receive a full refund of their Entry Fee.
  • All routes, set of staircases, lifts and exit doors prepared are safe and fit for use during the Event. Nevertheless, the Organiser reserves the right to amend the Event route to avoid any potential hazard occurrences at any time without prior notice to the Participant PROVIDED THAT the Organiser shall take such reasonable steps to inform the Participant on the changes before the Event Date.

5. PERSONAL DATA & INFORMATION

  • By signing up for the Event and providing any information, personal or otherwise, in order to participate in the Event, and/or any activity involving the Organiser, the Participant has expressly given consent to Organiser, event sponsors (the sponsors), event photographer and travel partner:

(a) to collect, analyse, collate, share, disclose to third parties, sell and/or otherwise use without any liability to the individual, any personal information relating to that individual as may in its sole discretion deem fit, including without any limitation for its programmes, planning, data-processing, and statistical or risk-analysis, research, fund-raising and/or any other purposes in furtherance of the functions. The Organiser and the sponsors declare by virtue of being the Event owner or sponsor, they can use services of third parties;

(b) to process and use the personal data collected for organisation, administration, research and promotion purposes;

(c) to post the full Event results on the Event’s website after the Event; and

(d) to use any photographs (including those of participants), motion pictures, recordings, or any other media records of the Event, for any legitimate purpose including commercial advertising and distribution to Sponsors anywhere in the world.

  • The Organiser reserves the right to utilise any photographs, audio, recordings, or any videos taken in the period of during, pre- and post-event for any legitimate purpose which is not limited to commercial advertising.
  • The Participant agrees to provide information that is true, accurate and complete regardless of whether it is personal or general information related to the Participant.
  • The Participant is to provide the relevant updates of the data and information upon Registration of the Event to ensure the authenticity, accuracy and timeliness of the data provided by the Participant.
  • The Organiser will not entertain any disputes arising from incomplete or inaccurate details on the Registration Form.

6. PARTICIPANT SAFETY

  • Strictly no animals, pets, tricycles, bicycles, push-carts, in-line skates, shoes with built-in or attached rollers and any other wheel-run objects and any form of support vehicles are allowed during the Event unless prior written permission or consent from the Organiser has been given. Any said materials or support found to be used by the Participant will be disqualified from the Event immediately.
  • Participants are responsible for their recognition and understanding of Event signage, symbols and colour relating to participant maps, facilities and direction.
  • The Organiser reserves the right to check any item or bag or the Participant if deemed suspicious or hazardous and which are likely to cause any danger, risk or hazard to other Participants present during the Event.
  • Medical personnel authorised by the Event may examine any Participant who appears to be in distress. If in the sole opinion of authorised medical personnel it is in the best interest of the Participant’s health and welfare to remove said Participant from the Event, said medical personnel may remove the participant from the Event.
  • The Participant must retire from the Event immediately if required to do so by any member of the Event’s official medical staff, event manager, security officer, or volunteers.

7. EXCLUSION OF RESPONSIBILITIES/LIABILTY

  • While every reasonable precaution will be taken by the Organiser to ensure the Participants’ safety, the Participant runs solely at their own risk and the Organiser will not be responsible or held liable for any injury or death howsoever arising from training for, during, or after participation in the Event. The Participant is strongly encouraged to go for a medical examination and/or consult their medical practitioner prior to the Registration and before the actual Event Day.
  • The Organiser shall not be held responsible or liable for any loss and/or damage to the personal belongings carried by the Participant. The Participant is strongly advised to leave their valuables at home and bring as little items as possible while participating in the Event.
  • The Participant shall indemnify and keep indemnified the Organiser from and against all actions, claims, demands, losses, damage, costs and expenses which the Organiser shall or may be or become liable as a consequence of any act, omission or negligence of the Participant or any breach or non-compliance by the Participant of any rules and regulation stipulated herein.
  • The Organiser will not be responsible for the behaviour of any spectator or third party.
  • The Organiser will not be responsible for any issues or allergies resulting from food and drink products given out on the Event Day.

8. EVENT DAY

  • The Participant must wear and display their allocated Event identification bib tag visibly at the front and the back of their T-shirt/ running vest at all times during the Event. Failure to do so will result in the Participant being removed by the Event officials/marshals and disqualified from taking part in the Event.
  • Any trading, exchange or selling of the Event identification tag is strictly not allowed. Our timing chips are guaranteed 99% average read success for the Race.
  • Every care is taken to ensure the functionality of the Event ID bib. However, the Organiser is not held responsible if the Event bib does not display accurate and successful time read after the Event.
  • All Participants who have successfully completed the race will be awarded a finisher’s medal and goodies bag upon presentation of their Event ID bib number to the respective officials at the medal collection counter and they must be collected on the Event Day or else no requests will be entertained thereafter.

9. RESULT AND AWARDS

  • Participant who is a category winner must report to the designated area to be prescribed by the Organiser on the Event Day and stay for the prize-giving ceremony which will be held after the end of the Event. All winners must present their supporting documents such as identity card (Malaysian), Passport (Foreigners) or driving license for verification at the prize winners’ counter.
  • The Organiser reserves the right to forfeit the winning prize for any Participant who fails to report to the designated area within 15 minutes after crossing the finishing line.
  • Any dispute or related appeals in regards to the result of the Event must be submitted to the Organiser in writing or via e-mail together with an appeal fee of RM50.00 within three (3) days after the Event Day; failing which, it will not be entertained by the Organiser.

  • All Participants who have successfully completed the Event will also be awarded with an e-Certificate of Participation, which will be made available on the Event Website until 10 October 2017, 6 pm.
  • All prizes and certificates are not transferable.

10. AMENDMENTS/RESERVATIONS/ACKNOWLEDGEMENTS

  • The Organiser reserves the right to unilaterally change, amend, add on, modify or substitute any of the above Terms and Conditions at any time as they deem fit in its sole and absolute discretion without any prior notice or any reasons thereof.
  • Should there be any ambiguity in any of the provisions, the Organiser shall be the sole authority which has the absolute, full and final and complete power to interpret as they deem fit.

11. GENERAL PROVISIONS

  • If any provision in the Terms and Conditions, whether in full or in part, is held to be invalid or unenforceable, all other remaining provisions (in full or in part) shall continue to be valid and enforceable.
  • These Terms and Conditions shall be subject to the law of Malaysia and the Parties agree to submit to the exclusive jurisdiction of the Courts of Malaysia.
  • The Participant may not assign transfer or deal in any other manner with these Terms and Conditions or any of its rights under it without the prior written consent of the Organiser.
  • These Terms and Conditions and the documents referred to herein constitute the entire agreement and understanding between the Parties and supersedes any previous agreement between the Parties relating to the subject matter herein. No other term or condition submitted, proposed or stipulated will apply to these Terms and Conditions. The Participant acknowledges that it has not, in entering into these Terms and Conditions, relied on any statement, representation or assurance that is not expressly set out in these Terms and Conditions or any document referred to herein.

STAIRATHON TERMS & CONDITIONS

1MK Retail Sdn. Bhd. is the official organiser of this anticipated, first-ever fitness event known as Stairathon 2017 which will be held at 1 Mont Kiara Shopping Mall.

All Participants are bound by the following terms and conditions which are deemed effective throughout the duration of the Event.

1. DEFINITION

  • “Entry Fee” means the price of entry into the Event as set out in the Registration Form.
  • “Event” means Stairathon 2017 organised by the Organiser to be held at 1 Mont Kiara.
  • “Event Day” means the date of the Event which is on 24 September 2017.
  • “Organiser” means 1MK Retail Sdn. Bhd.
  • “Participant” means the person who will be participating in the Event.
  • “Parties” means the Organiser and the Participant.
  • “1 Mont Kiara” means 1 Mont Kiara shopping mall located at No. 1, Jalan Kiara, Mont’ Kiara, 50480 Kuala Lumpur.
  • “Race Pack” means the official pack issued by the Organiser to the Participant containing all relevant Event materials.
  • “Registration” means registration for the participation of the Event by way of online registration or on-site registration.
  • “Registration Form” means the such registration form prescribed by the Organiser to be completed by the Participant in order to apply, register and pay for participation in the Event.
  • “Terms and Conditions” means the terms and conditions relating to the Event as set out below.

2. REGISTRATION AND ELIGIBILITY

  • Registration can be made either by online registration portal or at our on-site registration counter located at 1 Mont Kiara which will be informed via our marketing materials and social media websites. The Participant shall complete the Registration Form and submit it together with payment of the Entry Fee in accordance with the prescribed manner.
  • Any individual irrespective of nationality whose age meet the minimum age of 18 on the Event Day is eligible to participate in the Event in accordance with the following categories :

(a) Category A – Female aged 18 to 40

(b) Category B – Male aged 18 to 40

(c) Category C – Female aged 40 and above

(d) Category D – Male aged 40 and above

  • The Participant will be placed under listed categories according to their age group upon the Registration. For avoidance of doubt, anyone who is below the age of 18 is not allowed to participate.
  • Each participant must sign the Release Of Claims, Waiver Of Liability And Assumption Of Risk in such form and upon such terms to be prescribed by the Organiser before participating in the Event.
  • The Organiser reserves the right to refuse participation of any entries without assigning any reasons thereof.
  • The Organiser also reserves the right to cancel, vary and/or add any Event category without giving any prior notice.
  • The Participant is strictly not allowed to transfer their entries to another party or change Event categories after their Registration are finalised.
  • The Participant who is prone to heart attacks, asthma, high/low blood pressure, respiratory and skin problems, other related health complications, acrophobia (“fear of heights”) is strongly advised NOT to participate.
  • The Participant is strongly advised to consult with their medical practitioner to ensure that their health (both mental and physical fitness) is permissible to enter into the Event. To ensure safety of the Participant, they are advised to follow the route designated and observe traffic regulations.
  • The Participant may collect their Race Pack at the place and date to be informed by the Organiser via its marketing materials or any of the Organiser’s existing social media website.
  • The Participant is solely responsible to ensure that they arrive and collect their Race Pack before the collection period closes.

3. ENTRY FEE

  • For online registration, Entry Fee can be paid by your country’s currency via your existing Paypal account or in Malaysian Ringgit (MYR). For on-site registration, Entry Fee must be made in Malaysian Ringgit (MYR). The Participant acknowledges that the Entry Fee is non-refundable.
  • Upon payment of Entry Fee being made, the Participant’s participation for this Event is confirmed and we will send them an email notification with the issuance of an Event identification number, which is non-exchangeable for any other items.
  • If the Participant does not receive any email notification within 24 hours after the payment has been made, the Participant has to report this issue to the Organiser within three (3) working days. Only full payment of the Entry Fee is deemed accepted as participation into the Event.
  • By submitting an application and paying the Entry Fee, the Participant agrees to enter the Event and also agrees to abide by all Terms and Conditions stipulated herein and any instructions given to them by the Organisers, officials and marshals before, during or after the Event.
  • The Participant shall not be entitled to a refund of the Entry Fee if he or she is disqualified from the Event as a result of a breach of any Terms and Conditions stipulated herein.

4. DISQUALIFICATION, CANCELLATION, WITHDRAWAL AND ALTERATIONS

  • Entries are non-transferable either to a different Participant or to another event in the current year or in future years.
  • The participant who fails to arrive at the start line on time will be assumed withdrawn from the Event and will not be eligible to a refund of any kind. No late starters will be permitted to cross the start line.
  • The Organiser reserves the right to alter the start time of the Event. In the event of a change of start time, the Participant will be notified of the revised start time. No refund shall be made for any change in start time for the Event.
  • If the Event is cancelled due to circumstance beyond the control of the Organiser including but not limited to, an act of God, explosion, acts of a public enemy, war, insurrection, terrorist act or threat of terrorist act, sabotage, epidemic, embargoes or strikes, the Participant shall not be entitled to a refund of the Entry Fee and compensation of any kind.
  • The Organiser reserves the right to alter the start time of the Event. In the event of a change of start time the Participant will be notified of the revised start time. No refund shall be made for any change in start time for the Event.
  • The Organiser reserves the right to change the date of the Event. In the event of such change of date of the Event, where the Participant is unable to attend on the revised date, he/she has fourteen (14) days to inform the Organiser in writing (or by email) from when the change in date is announced to receive a full refund of their Entry Fee.
  • All routes, set of staircases, lifts and exit doors prepared are safe and fit for use during the Event. Nevertheless, the Organiser reserves the right to amend the Event route to avoid any potential hazard occurrences at any time without prior notice to the Participant PROVIDED THAT the Organiser shall take such reasonable steps to inform the Participant on the changes before the Event Date.

5. PERSONAL DATA & INFORMATION

  • By signing up for the Event and providing any information, personal or otherwise, in order to participate in the Event, and/or any activity involving the Organiser, the Participant has expressly given consent to Organiser, event sponsors (the sponsors), event photographer and travel partner:

(a) to collect, analyse, collate, share, disclose to third parties, sell and/or otherwise use without any liability to the individual, any personal information relating to that individual as may in its sole discretion deem fit, including without any limitation for its programmes, planning, data-processing, and statistical or risk-analysis, research, fund-raising and/or any other purposes in furtherance of the functions. The Organiser and the sponsors declare by virtue of being the Event owner or sponsor, they can use services of third parties;

(b) to process and use the personal data collected for organisation, administration, research and promotion purposes;

(c) to post the full Event results on the Event’s website after the Event; and

(d) to use any photographs (including those of participants), motion pictures, recordings, or any other media records of the Event, for any legitimate purpose including commercial advertising and distribution to Sponsors anywhere in the world.

  • The Organiser reserves the right to utilise any photographs, audio, recordings, or any videos taken in the period of during, pre- and post-event for any legitimate purpose which is not limited to commercial advertising.
  • The Participant agrees to provide information that is true, accurate and complete regardless of whether it is personal or general information related to the Participant.
  • The Participant is to provide the relevant updates of the data and information upon Registration of the Event to ensure the authenticity, accuracy and timeliness of the data provided by the Participant.
  • The Organiser will not entertain any disputes arising from incomplete or inaccurate details on the Registration Form.

6. PARTICIPANT SAFETY

  • Strictly no animals, pets, tricycles, bicycles, push-carts, in-line skates, shoes with built-in or attached rollers and any other wheel-run objects and any form of support vehicles are allowed during the Event unless prior written permission or consent from the Organiser has been given. Any said materials or support found to be used by the Participant will be disqualified from the Event immediately.
  • Participants are responsible for their recognition and understanding of Event signage, symbols and colour relating to participant maps, facilities and direction.
  • The Organiser reserves the right to check any item or bag or the Participant if deemed suspicious or hazardous and which are likely to cause any danger, risk or hazard to other Participants present during the Event.
  • Medical personnel authorised by the Event may examine any Participant who appears to be in distress. If in the sole opinion of authorised medical personnel it is in the best interest of the Participant’s health and welfare to remove said Participant from the Event, said medical personnel may remove the participant from the Event.
  • The Participant must retire from the Event immediately if required to do so by any member of the Event’s official medical staff, event manager, security officer, or volunteers.

7. EXCLUSION OF RESPONSIBILITIES/LIABILTY

  • While every reasonable precaution will be taken by the Organiser to ensure the Participants’ safety, the Participant runs solely at their own risk and the Organiser will not be responsible or held liable for any injury or death howsoever arising from training for, during, or after participation in the Event. The Participant is strongly encouraged to go for a medical examination and/or consult their medical practitioner prior to the Registration and before the actual Event Day.
  • The Organiser shall not be held responsible or liable for any loss and/or damage to the personal belongings carried by the Participant. The Participant is strongly advised to leave their valuables at home and bring as little items as possible while participating in the Event.
  • The Participant shall indemnify and keep indemnified the Organiser from and against all actions, claims, demands, losses, damage, costs and expenses which the Organiser shall or may be or become liable as a consequence of any act, omission or negligence of the Participant or any breach or non-compliance by the Participant of any rules and regulation stipulated herein.
  • The Organiser will not be responsible for the behaviour of any spectator or third party.
  • The Organiser will not be responsible for any issues or allergies resulting from food and drink products given out on the Event Day.

8. EVENT DAY

  • The Participant must wear and display their allocated Event identification bib tag visibly at the front and the back of their T-shirt/ running vest at all times during the Event. Failure to do so will result in the Participant being removed by the Event officials/marshals and disqualified from taking part in the Event.
  • Any trading, exchange or selling of the Event identification tag is strictly not allowed. Our timing chips are guaranteed 99% average read success for the Race.
  • Every care is taken to ensure the functionality of the Event ID bib. However, the Organiser is not held responsible if the Event bib does not display accurate and successful time read after the Event.
  • All Participants who have successfully completed the race will be awarded a finisher’s medal and goodies bag upon presentation of their Event ID bib number to the respective officials at the medal collection counter and they must be collected on the Event Day or else no requests will be entertained thereafter.

9. RESULT AND AWARDS

  • Participant who is a category winner must report to the designated area to be prescribed by the Organiser on the Event Day and stay for the prize-giving ceremony which will be held after the end of the Event. All winners must present their supporting documents such as identity card (Malaysian), Passport (Foreigners) or driving license for verification at the prize winners’ counter.
  • The Organiser reserves the right to forfeit the winning prize for any Participant who fails to report to the designated area within 15 minutes after crossing the finishing line.
  • Any dispute or related appeals in regards to the result of the Event must be submitted to the Organiser in writing or via e-mail together with an appeal fee of RM50.00 within three (3) days after the Event Day; failing which, it will not be entertained by the Organiser.

  • All Participants who have successfully completed the Event will also be awarded with an e-Certificate of Participation, which will be made available on the Event Website until 10 October 2017, 6 pm.
  • All prizes and certificates are not transferable.

10. AMENDMENTS/RESERVATIONS/ACKNOWLEDGEMENTS

  • The Organiser reserves the right to unilaterally change, amend, add on, modify or substitute any of the above Terms and Conditions at any time as they deem fit in its sole and absolute discretion without any prior notice or any reasons thereof.
  • Should there be any ambiguity in any of the provisions, the Organiser shall be the sole authority which has the absolute, full and final and complete power to interpret as they deem fit.

11. GENERAL PROVISIONS

  • If any provision in the Terms and Conditions, whether in full or in part, is held to be invalid or unenforceable, all other remaining provisions (in full or in part) shall continue to be valid and enforceable.
  • These Terms and Conditions shall be subject to the law of Malaysia and the Parties agree to submit to the exclusive jurisdiction of the Courts of Malaysia.
  • The Participant may not assign transfer or deal in any other manner with these Terms and Conditions or any of its rights under it without the prior written consent of the Organiser.
  • These Terms and Conditions and the documents referred to herein constitute the entire agreement and understanding between the Parties and supersedes any previous agreement between the Parties relating to the subject matter herein. No other term or condition submitted, proposed or stipulated will apply to these Terms and Conditions. The Participant acknowledges that it has not, in entering into these Terms and Conditions, relied on any statement, representation or assurance that is not expressly set out in these Terms and Conditions or any document referred to herein.
